These Terms & Conditions apply to your use of the MySepticCheck website, account area, property checks and Seller Information Packs.
By creating an account, purchasing a Seller Information Pack or otherwise using MySepticCheck, you agree to these Terms & Conditions.
1. About MySepticCheck
MySepticCheck is a trading name of Harris Retail Solutions Limited, company number 08057789, registered in England and Wales. Our registered office is 52 Gold Street, Northampton, England, NN1 1RS.
MySepticCheck is an online information and readiness service designed to help property sellers organise information about septic tanks, sewage treatment plants and other off-mains drainage systems.
The service is currently designed for properties in England.
2. What the service provides
MySepticCheck may allow you to:
- Create and manage an account
- Complete questions about a property's off-mains drainage system
- Add maintenance and system information
- Upload supporting information or documents
- Receive a Green, Amber or Red readiness indication
- Create a Seller Information Pack based on the information you provide
3. MySepticCheck is not a compliance service
MySepticCheck does not certify or guarantee that any septic tank, sewage treatment plant, drainage field, discharge point or other drainage system complies with environmental, planning, building regulation or other legal requirements.
The service does not replace a physical inspection, survey, environmental permit, legal opinion, conveyancing advice or advice from an appropriately qualified drainage professional.
4. Green, Amber and Red results
Green, Amber and Red are MySepticCheck readiness indicators based on the information entered into the service.
A Green result does not guarantee compliance and an Amber or Red result does not, by itself, establish that a drainage system is unlawful or non-compliant.
5. Your responsibilities
You are responsible for:
- Providing information that is accurate to the best of your knowledge
- Keeping your account and password secure
- Only uploading documents and information you are entitled to provide
- Checking information before sharing your Seller Information Pack
- Obtaining professional advice where necessary
You must not knowingly provide false, misleading or fraudulent information through MySepticCheck.
6. Seller Information Packs
Seller Information Packs are generated from information supplied through MySepticCheck.
We do not independently verify every statement, document, maintenance record or item of information provided by a user.
You should review your Seller Information Pack before providing it to a buyer, estate agent, conveyancer or other third party.
Seller Pack gifts
A buyer or other person may purchase a one-property Seller Pack gift link for a property seller. The link is transferable until it is claimed and should be shared privately. It can be claimed once.
The seller uses their own account, controls the information and documents they add, and decides whether to share the finished pack. Purchasing a gift does not require the seller to complete or share it and does not give the purchaser access to the seller\'s account or property information.
7. Pricing and payment
Prices will be shown clearly before payment is required.
Unless otherwise stated, payment relates to the relevant MySepticCheck service or Seller Information Pack for the property selected by the user.
We may change our prices from time to time. Any change will not affect a purchase that has already been completed.
8. Cancellations and refunds
Your legal rights as a consumer are not affected by these Terms.
Because MySepticCheck provides digital services and digital content, cancellation rights may depend on whether you have asked us to begin providing the service immediately and whether the service or digital content has already been supplied.

9. Availability of the service
We aim to keep MySepticCheck available and reliable, but we cannot guarantee that the website or service will always be available without interruption.
We may temporarily suspend access for maintenance, security, technical or operational reasons.
10. Changes to the service
We may update, improve or change MySepticCheck as the service develops, including questions, guidance, readiness logic and Seller Information Pack formats.
11. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
MySepticCheck is an information and organisational service. You remain responsible for decisions relating to your property, drainage system and property transaction and for obtaining suitable professional advice where needed.
We are not responsible for losses caused by inaccurate, incomplete or misleading information supplied by a user, or by reliance on MySepticCheck as a substitute for legal, technical or professional advice.
12. Intellectual property
The MySepticCheck website, branding, software, content and service design are protected by intellectual property rights.
You may use Seller Information Packs created for your own property transaction, but you may not copy, reproduce or commercially exploit the MySepticCheck service or website without permission.
13. Privacy
Your use of MySepticCheck is also subject to our Privacy Policy and Cookie Policy.
14. Ending or restricting access
We may restrict or suspend an account where we reasonably believe the service is being misused, used fraudulently or used in a way that may harm MySepticCheck or other users.
15. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer, you retain any mandatory rights you have under applicable consumer law.
